Attorney General Hilgers Files U.S. Supreme Court Brief in Support of Parents’ Religious Rights

Lincoln - Nebraska Attorney General Mike Hilgers filed an amicus brief in the United States Supreme Court supporting the religious rights of parents to object to vaccination requirements for their daughter who attends an online-only public school. Krystal and Anthony Perry believe that vaccinations developed from the remains of aborted fetuses violate their Christian faith. But a West Virginia school district has disenrolled the Perrys’ daughter because they refuse to vaccinate her, even though their daughter was attending online public school at home. Lower courts rejected the Perrys' case, and Attorney General Hilgers led a coalition of 16 attorneys general encouraging the U.S. Supreme Court to take it.

“Our Nation has long defended the rights of parents to raise their children according to their faith. The government can intrude upon this right only in the most pressing circumstances. Those circumstances do not include the vaccination status of a student doing school in her own home. Our office remains committed to supporting the constitutional rights of parents in Nebraska and beyond.”

Attorney General Hilgers thanked the attorneys general of Alabama, Alaska, Arkansas, Florida, Idaho, Indiana, Iowa, Kansas, Louisiana, Missouri, Montana, South Carolina, South Dakota, Utah, and West Virginia for joining the effort.
